Kratom Establishment Registration
To operate legally in Utah’s kratom market, establishments must register with the Utah Department of Agriculture and Food (UDAF) based on their business activities. This ensures compliance with the Kratom Consumer Protection Act (KCPA) and associated administrative rules. There are two primary categories for kratom establishment registration: Kratom Manufacturing Establishment or Kratom Retail Establishment.
Registering as a Kratom Manufacturing Establishment
This applies if your establishment is located in the state of Utah and is involved in the distributing, extracting, holding, formulating, mixing, or white labeling of kratom products. These activities classify your facility as a “kratom processor”, which requires registration as a manufactured food establishment under the Utah Wholesome Food Act (Title 4, Chapter 5) and the KCPA (Title 4, Chapter 45).

Registering as a Kratom Retail Establishment
This applies if your establishment sells pre-packaged and labeled kratom products directly to the end consumer (including online). This role is recognized as a “kratom retailer” as defined in R66-50, which requires a food establishment permit and a kratom retail permit under the KCPA and the Kratom Retail Permit Rule R66-50.
To Apply for a New Retail Permit
- Visit the Agricultural Information Management System (AIMS)
- Login to your account
- Click on the "Kratom" section
- Select โRetail Permit Application.โ
- Click โContinue.โ
- Read and agree to acknowledgements, then click โSave and Proceedโ.
- Choose โNew Applicationโ, then โSave and Proceedโ.
- Complete the application and pay the application fee.
- If you have multiple establishments (including online), they all need to have a retail permit. You can add an additional location to your application by selecting โAdd Locationโ on the Account Informationโ screen within the application. You will need to submit a new application for each location.
Retail Permit Fee and Application Review
- Non-refundable Fee: A non-refundable fee of $100 is required for each location. An online retail website is considered a separate location and needs to have a separate retail permit.
- Payment Requirement: Applications will not be reviewed until full payment is received.
- Notification: Applicants will receive email notifications regarding the status of their application, including requests for additional information, approval, or denial.
Renewing Retail Permit
- Visit the AIMS portal: https://agbusiness.utah.gov/s/
- Log in to your account.
- Click on the “Kratom” section.
- Select “Retail Permit Application.”
- Click “Continue.”
- Read and agree to acknowledgements, then click “Save and Proceed”.
- Choose “Renewal Application”, then “Save and Proceed”.
- Select the permit that you would like to renew, then “Save and Proceed”.
- Only one permit can be selected at a time.
- Complete the application and pay the application fee.
Updating an Existing Retail Permit
- Visit the AIMS portal: https://agbusiness.utah.gov/s/
- Log in to your account.
- Click on the “Kratom” section.
- Select “Retail Permit Application.”
- Click “Continue.”
- Read and agree to acknowledgements, then click “Save and Proceed”.
- Choose “Change Request”, then “Save and Proceed”.
- Select the permit that you need to make changes to, then “Save and Proceed”.
- Only one permit can be selected at a time.
- Complete the application.
By registering as a Utah Kratom Retail Establishment, you are agreeing to theย KCPAย and the Kratom Retail Permitย Rule R66-50.
