Medical Cannabis
As outlined in 4-41a, the licensing board shall consist of three directors hired by the commissioner. At least one member of the licensing board shall have experience related to public health or medicine and all members are Ethics, GRAMA, and Public Meetings Act trained.

Board Authority and Duties

The board shall meet to review cannabis production establishment, medical cannabis pharmacy, and medical cannabis courier license applications and review each license application for compliance with:

  • Utah Code Title 4, Chapter 41a
  • Department rules

Additionally, the board's duties include:

  • Conducting a public hearing to consider the license application
  • Approving the department's license application forms and checklists
  • Making a determination on each license application

The board shall hold a public hearing to review a cannabis production establishment's or medical cannabis pharmacy's license if the establishment:

  • Changes ownership by an interest of 20% or more
  • Changes or adds a location
  • Upgrades to a different licensing tier under department rule
  • Changes extraction or formulation standard operating procedures
  • Adds an industrial hemp processing or cultivation operation to the same location as the cannabis production establishment's processing facility
  • Takes action as necessary based on the recommendation of the department

The board shall meet as necessary to consider cannabis production establishment, medical cannabis pharmacy, and medical cannabis courier license renewal applications.
