This section provides answers to common questions regarding the Utah Kratom Regulation Act (KRA) and the regulation of kratom products in Utah.

What products require separate registrations?

As per Rule R66-51, a separate registration fee is required for each uniquely labeled kratom product. Product sizes for an identical label are not considered unique and do not require separate registrations.

Examples:

  • One Registration: “Green Powder” sold in 100g, 200g, and 1kg sizes, all with the same label design and product name, requires 1 registration.
  • Two Registrations: “Green Powder” (100g, 200g, 1kg) and “Green Capsule” (10ct, 50ct, 100ct) would require 2 separate registrations because they are distinct product forms.
  • Four Registrations: “Green Powder” (100g, 200g, 1kg); “Green Capsule” (10ct, 50ct, 100ct);  “Red Powder” (100g, 200g, 1kg) and “Red Capsule” (10ct, 50ct, 100ct) would require 4 separate registrations because they are distinct product forms/labels.

How long is a product registration valid?

Product registration in Utah is based on the state’s fiscal year. A registration is valid from the date of approval until June 30th of each year.

A new registration, including payment of the non-refundable fee, is required annually for each registered product. Renewals for the upcoming fiscal year typically begin on May 1st.

Please note that fees cannot be prorated if you register a product late in the fiscal year.

Are there any types of kratom products or delivery forms that are not allowed?

Yes, anything that is not Pure Leaf Kratom can not be distributed or sold in Utah.

  • Pure Leaf Kratom means a kratom product that:
    • is identifiable as plant matter or is identifiable plant matter contained in an encapsulating agent.
    • is not mixed or packed with a nonkratom substance unless the nonkratom substance is an inert encapsulating agent that:
      • is composed of food-grade or pharmaceutical-grade materials with no pharmacological activity;
      • contains no psychoactive substances, stimulants, or adulterants; and
      • serves solely to contain or deliver the plant matter;
      • does not contain any kratom extract; and
      • does not contain 7-hydroxymitragynine at a level greater than 0.4% of the total kratom alkaloid composition of the product.
  • Any form that mimics a candy product or is manufactured, packaged, or advertised in a way that appeals to an individual under 21 years of age.

Are there any compounds or ingredients that are not allowed or limited in kratom products?

    • is identifiable as plant matter or is identifiable plant matter contained in an encapsulating agent.

What are the penalties for non-compliance with the KRA?

Non-compliance with the Utah Kratom Regulation Act can result in:

  • An administrative fine for selling an unregistered kratom product (Section 4-45-108).
  • Seize and destroy any unregistered kratom product offered for sale in the state (Section 4-45-108).
  • Initiate a recall of kratom products (Section 4-45-107).
  • Revoke existing registrations or deny future registrations (Section 4-45-107).
  • A first violation of Section 4-45-104 is a class B misdemeanor.
    • Second violation is a class A misdemeanor.
    • Subsequent violations are 3rd degree felonies.
  • A Class A misdemeanor for anyone found to be selling to anyone under the age of 21 (Section 4-45-105).

What is the minimum age to purchase kratom in Utah?

According to Section 4-45-105(1), A kratom processor may not distribute, sell, or offer for sale a kratom product to an individual under 21 years of age.

Can law enforcement "sting" my shop?

  • Yes. Law enforcement is explicitly authorized to conduct underage buy investigations to ensure retailers are not selling THC-containing products to minors

How to Find and Download Active Licenses

  • Access the Portal Go to the official Utah Department of Agriculture and Food (UDAF) business portal at agbusiness.utah.gov.
  • Log In Enter your username and password associated with your business account.
  • Navigate to My Records Once on your dashboard, look for the section titled "My Records." This is the central hub for all your applications, permits, and registrations.
  • View Licenses Click on the "My Licenses" tab within that section.
  • Filter for Active Status Select the "Active Licenses" view. This will filter out any expired or pending applications, showing only those currently in good standing.
  •  Download and Print Locate the specific license you need (e.g., Industrial Hemp Retailer Permit or Cannabinoid Processor License). Click on the license record; there is typically a button or link to "Download License" or "Print Certificate."

Why is the address in my retail permit application greyed out? 

  • The greyed-out address is your overall corporate/account address. This cannot be edited directly inside a specific application. To update this:
    • Follow the Updating Profile and Contacts link to change it in your account settings.
    • Alternatively, email [email protected] to request an account address change.
    • Once submitted, staff will review and approve the request, and you will receive a confirmation email.

Where do I enter the actual store location if the main address is greyed out? 

  • The individual store address is managed in the “Additional Location” field at the bottom of the application.
  • You can search for an existing location by name or manually add a new address.
  • The address entered here will reflect on the left-hand side of your final permit.

My permit shows the "wrong" address in the top/middle section. Is this an error? 

  • Not necessarily. The Account/Corporate address of your company is designed to show in the top, middle, and right sections of the permit. 
  • The specific Store Address appears in the "Approved Location" field. If there is a factual error in your corporate address, email [email protected] for a correction.

Do I need a separate permit to sell Hemp products?
