Statutes and Administrative Rules

The Specialized Products Division regulates kratom products in Utah under the Kratom Consumer Protection Act (KCPA), which was established by Senate Bill 58 during the 2019 general legislative session and became effective on May 14, 2019. These legal frameworks ensure consumer protection, product safety, and proper industry oversight. Below are the primary legal documents relevant to Utah’s Kratom Program:

Statute

  • Utah Kratom Consumer Protection Act (KCPA): This foundational act establishes the legal framework for kratom regulation in Utah. It outlines definitions, prohibited acts, labeling requirements, registration duties for the Department of Agriculture and Food (UDAF), and rulemaking authority.

Administrative Rules

Rule R70-580. Kratom Manufacturer Food Establishment Registration: Pursuant to Section 4-45-107 and Subsection 4-5-301(1), this rule establishes the requirement for a kratom manufacturer to register as a food establishment.
